PEQUANNOCK - Speedy trial sought for accused child molester

PEQUANNOCK - The Morris County Prosecutor’s Office is urging a speedy resolution of the legal case against a 27-year-old Bloomingdale man accused of sexually assaulting a 5-year-old township girl in her own bedroom last year.

During a status conference held Aug. 22 before Superior Court Judge Salem Vincent Ahto in Morristown, Timothy Iberer’s attorney told how he’s in the process of possibly obtaining an expert for their case. A pre-trial conference was then scheduled for Sept. 12.

In providing this court update, the Prosecutor’s Office took the opportunity to urge that the wheels of justice turn without delay in the case against Iberer, who has been indicted on sexual assault and attempted sexual assault charges along with burglary and endangering the welfare of a child.

“The family is dealing with a very difficult situation through no fault of their own,” said Prosecutor Robert Bianchi. “They are a decent family and good parents and we would hope that the community will continue to support them during this difficult time,” he said in a written statement issued Friday.

Iberer, who was previously convicted of sexually assaulting a young girl in Clifton, is now being held at the Adult Diagnostic and Treatment Center in the Avenel section of Woodbridge where sex offenders get treatment during their jail term. His bail is set at $1 million.

If convicted on the more recent charges, Iberer could serve roughly 40 years and would be subject to the No Early Release Act, Parole Supervision for Life as well as Megan’s Law, which could have his name posted on a state police sex offender Web site alerting the public.

The charges stem from three separate incidents at a township home between Aug. 1, 2007 and Sept. 10, 2007. At approximately 3 a.m. on Sept. 10, the girl’s mother, worried because her daughter’s bedroom door was closed, found that an individual, believed to be the defendant, was in the child’s room. Although the individual jumped out the window and fled, police investigated and brought charges against Iberer, who was arrested Sept. 21 in Bloomingdale. He had registered as a sex offender in that town.

Authorities suspect that Iberer gained access to the bedroom by cutting both corners of a screen leading to the first-floor bedroom window.

The matter was jointly investigated by the Morris County Prosecutor’s Office, Sheriff’s Office, Pequannock Police, and the State Police.
